That benefit arises when the transitional arrangement is combined with the agreed rent: in that case, the tax rate on rental income can fall from 21 per cent to 10 per cent. It may seem like a technical detail, but it makes a real difference to the figures.

However, this arrangement only works under certain conditions, which depend on the location of the property and the way in which the contract is actually drawn up. Anyone who overlooks these conditions may not realise it straight away, but will only find out later when filing their tax return – or, worse still, during a tax audit – by which time it is too late to rectify the situation.

In this guide, we look at how the transitional contract works, what distinguishes a free-market rent from an agreed rent, how an agreed rent is actually calculated, what the tax benefits are in detail, and what mistakes can cause those who are fully entitled to the relief to lose out on it.

The information contained in this guide is provided for information purposes only and reflects the legislation and local agreements in force at the date of publication. Local agreements are updated periodically by the signatory associations, and rent brackets vary from one local authority to another: before signing, you should always check the current tables for your local authority.

If you want to start with the basics, you’ll find a step-by-step guide to how the contract works in our dedicated guide: Temporary tenancy agreement: what it is and when it is worth using. Here, we focus on what matters most to landlords: the tax aspects, and how to avoid accidentally missing out on a tax relief scheme to which you are entitled.

What is a short-term tenancy and when can it be used?

The transitional tenancy agreement is governed by Article 5 of Law No. 431 of 1998 and by the Interministerial Decree of 16 January 2017, the measure which reformed all tenancy agreements other than those based on a freely agreed rent and which remains the reference text to this day.

To understand what sets it apart from the others, it is worth summarising the three main types of residential tenancy:

The 4+4 tenancy, i.e. the open-market tenancy, lasts for four years and is automatically renewed for a further four, unless the landlord gives notice of termination for valid reasons. The rent is freely agreed between the parties. It is the most common but least flexible option.

The ‘3+2’ scheme – that is, the rent-controlled tenancy agreement – lasts for three years plus two years’ renewal; in return for this shorter term, it imposes a rent capped in accordance with local agreements.

A fixed-term tenancy is not a shortened version of the previous types, but a tenancy agreement that only exists if there is a specific reason why the tenancy must be temporary. Let’s look at the details.

Shelf life: no more than 18 months

The decree sets a clear limit: a transitional contract may not exceed 18 months in duration. There is no statutory minimum, so it may be entered into for as few as a few months, but beyond 18 months this type of contract simply cannot be used.

Upon expiry, there is no automatic renewal: the contract simply ends. If the circumstances that justified it still apply, the parties may enter into a new contract with an updated justification; if, on the other hand, the tenancy is allowed to continue without any action being taken, there is a risk that it will be regarded as an ordinary tenancy, with all the consequences that entails.

A useful technical requirement to be aware of: for contracts lasting longer than thirty days, the decree requires that the need for a temporary arrangement be substantiated by specific documentation to be attached to the contract. For contracts of less than thirty days, the formalities are less stringent.

Consideration: the element that renders the contract valid

This is the crux of the matter, and the point where almost all the problems converge.

A short-term tenancy is not a matter of choice for the landlord: it is the result of a genuine temporary need, which must relate to the landlord, the tenant or both, and which must be specified in the tenancy agreement and documented.

The 2017 decree identifies the categories of relevant needs (work-related travel, study, apprenticeships, vocational training, job-seeking) and leaves it to the local agreements of each municipality to specify them in detail. This has an important implication: the list of valid reasons is not the same throughout Italy, but depends on the agreement in force in the municipality where the property is located, and this is the first thing to check.

In practical terms, the most common situations are when a tenant is relocating for work, undertaking a fixed-term degree course or PhD, or undergoing long-term medical treatment away from home; or, from the landlord’s perspective, the realisation that the property will be needed again by a date that is more or less known.

It is therefore not enough simply to use a generic phrase such as ‘the tenant’s temporary needs’: the reason must be described in detail and supported by a document, such as a transfer letter, a university enrolment form or a booking for a course of treatment.

Who can take out a policy and for what purpose?

A transitional tenancy agreement may only be entered into between individuals and exclusively for residential purposes.

IN-DEPTH ANALYSIS: The transitional arrangement is not a short-term tenancy

This is the most common misconception – and also the most risky one. A transitional contract is intended for those who need to living in a property for a limited period: a student living away from home, a worker on secondment, a patient undergoing treatment in another city.

It is not intended to accommodate tourists. Holiday lettings are subject to their own rules, reporting requirements and tax regime. Using a short-term let for holiday stays exposes you to potential issues on both the tax and contractual fronts, and does not entitle you to any of the benefits discussed here.

Unregulated rent or agreed rent: which to choose

Now that we’ve clarified what a transitional tenancy is, we come to the choice that really determines how much tax you pay. And this choice is independent of the tenancy’s duration: a transitional tenancy can be either at a market rent or at an agreed rent, and the two options are treated differently for tax purposes.

Under the free rent system, the landlord sets the price dictated by the market. In return, a flat-rate tax of 21 per cent is applied to the rental income.

Under the rent agreement scheme, the landlord agrees to a rent falling within pre-determined bands, set locally by landlords’ and tenants’ associations. In return, they benefit from a reduced tax rate of 10 per cent.

The agreed rent therefore involves a real reduction in rent: according to estimates by the City of Florence, an agreed rent is, on average, around 30 per cent below free-market rates. This is not a negligible difference, and it is why the decision should be based on the figures rather than on principle: in some areas, the tax savings more than make up for the lower rent, whilst in others they do not.

In municipalities with high housing demand, the rent is determined in accordance with local agreements

The reduced rate of 10 per cent does not apply throughout Italy, but only if the property is situated in a so-called ‘municipality with high housing demand’, that is, an area which the law considers to be under pressure in terms of housing.

The list is set out in Article 1 of Decree-Law No. 551 of 1988 and comprises three groups:

the eleven cities identified by name: Bari, Bologna, Catania, Florence, Genoa, Milan, Naples, Palermo, Rome, Turin, Venice and the municipalities bordering them;

all other provincial capitals;

the additional municipalities with a high housing shortage identified by the Interministerial Committee for Economic Planning.

More specifically, therefore, as regards the Florence area, Florence, Prato and Sesto Fiorentino are all eligible for the reduced rate of 10 per cent.

That said, being in a municipality with high housing demand is a necessary but not sufficient condition. The rent must genuinely comply with the bands set out in the territorial agreement in force in that municipality, and each municipality has its own agreement, with its own map of zones.

In this regard, Florence and the municipalities within the Florentine LODE area have signed new territorial agreements, which will come into force on 7 July 2025, whilst Sesto Fiorentino has published the territorial agreement on rent-controlled residential tenancies on its municipal website, complete with a map of the zones and a certificate template.

The certificate of suitability: when it is required and who issues it

It is this step that, unfortunately, often causes the largest number of homeowners to lose out on the tax relief, because the rule is less straightforward than it seems.

The 2017 decree distinguishes between two ways of entering into a rent-controlled tenancy agreement:

The first is the assisted tenancy agreement: the landlord and tenant approach the trade associations that are signatories to the local agreement, which assist them in drawing up the agreement. In this case, the fact that the agreement complies with the terms of the local agreement is guaranteed by this assistance.

The second option is the non-assisted contract: the parties draw it up themselves, without going through any associations. This is the route many choose because it seems quicker. In this case, however, an additional document is required to qualify for tax relief: the certificate of compliance, commonly known as the certificate of adequacy.

This is a certificate issued by at least one of the organisations that are signatories to the territorial agreement, which certifies (and assumes responsibility for) that the financial and regulatory terms of the contract are in line with the agreement, including for the purposes of tax relief. The cost is generally in the region of a few tens of euros.

Without this certificate, an unregistered tenancy agreement remains perfectly valid as a tenancy, but does not entitle the tenant to the 10 per cent tax rate. This distinction does not become apparent on its own in the tax return: it only comes to light in the event of an audit, when the tax relief has already been applied for several years.

How is the agreed rent calculated?

As previously mentioned, the agreed rent is not set by the landlord but is a figure that falls within a pre-determined range.

The local agreements, signed on a municipality-by-municipality basis between landlords’ and tenants’ associations, divide the municipal area into homogeneous zones and, for each zone, periodically set a minimum and maximum value per square metre. Within that range, the actual rent is determined by applying a series of factors relating to the specific property.

The factors that carry the most weight are generally:

the area in which the property is situated, as shown on the map attached to the agreement;

the floor area, calculated in accordance with the criteria set out in the agreement, which do not always correspond to the commercial square metres used in the advertisements;

the condition of the building and the flat;

the presence of specific facilities: lift, independent heating, parking space or garage, terrace, garden, cellar;

any furniture, which is normally valued separately in the agreements.

The practical point. If the agreed rent falls outside the specified range, the contract remains valid but loses the entitlement to the 10 per cent flat-rate tax, even if it has been referred to as ‘agreed rent’. There is no official margin of tolerance: simply calling it that is not enough; it must comply with the figures.

Comparison table of tenancy agreements

Type of contract

Duration

Flat-rate tax

Flexibility

When it’s worth it

4+4 (rent not regulated)

4 years + automatic renewal for a further 4 years

21%

Low

High market rent, no price restrictions, landlord seeking long-term stability

3+2 (agreed rent)

3 years plus a further 2-year extension

10%*

Media

Significant tax savings in exchange for a capped rent, with a long-term tenant

Transitional scheme with no fixed fee

No later than 18 months

21%

High

A documented temporary need, in municipalities where there is no housing shortage or where market rents are significantly higher than the agreed bands

Transitional arrangement with an agreed rent

No later than 18 months

10%*

High

Documented temporary need + tax relief, in municipalities with a severe housing shortage (Florence, Prato, Sesto Fiorentino)

*The 10 per cent rate is subject to three conditions being met simultaneously: the municipality must be classified as having a high housing shortage, the rent must fall within the bands set out in the territorial agreement and (for contracts not supported by associations) a certificate of compliance must be provided.

Tax benefits for the owner

Let’s look at an example to see what changes in practice: Laura owns a flat in Florence and rents it out at an agreed rent under a transitional tenancy agreement, at 900 euros a month, amounting to a total annual rent of 10,800 euros.

Flat-rate tax, registration tax and stamp duty

Before looking at the figures, it is worth clarifying what we are talking about, as there are three distinct categories that are often confused with one another.

The flat-rate tax scheme is an optional tax regime introduced by Article 3 of Legislative Decree No. 23 of 2011. Without this scheme, the rent received by the landlord is added to all other income (salary, pension, VAT-registered income) and IRPEF tax rates are applied to the total, with these rates increasing as total income rises.

With the flat-rate tax, however, the rent is excluded from that calculation: you pay a fixed tax, calculated solely on the rent, and that is the end of it. This is why it is called a ‘substitute’ tax. The option is exercised at the time of registering the contract, or in any of the subsequent years, and applies for the chosen term.

The registration tax is payable to register the contract with the Revenue Agency; this is a mandatory requirement for any tenancy exceeding a total of thirty days in the year. It amounts to 2 per cent of the annual rent, with a minimum of 67 euros, and is not a one-off payment: it is payable for each year of the tenancy agreement. By law, it is payable by both parties, and in practice the landlord and tenant usually split the cost equally.

Stamp duty, on the other hand, is the revenue stamp that must be affixed to the copies of the contract to be registered: 16 euros for every four written pages. For a contract of normal length, in multiple copies, this amounts to a few tens of euros.

The key point for the owner is this: those who opt for the flat-rate tax scheme do not pay either registration tax or stamp duty, regardless of the rate applied. The saving, therefore, is not limited to the main tax.

With regard to Laura’s licence fee, the difference between the two rates is as follows:

with a flat-rate tax of 21 per cent, the tax would amount to 2,268 euros a year;

Under the 10 per cent flat-rate tax – that is, a rent agreed upon in a local authority area with a high housing shortage – the tax would instead amount to 1,080 euros a year.

The difference between the two is 1,188 euros a year, based solely on the tax on the licence fee.

Added to this is the unpaid registration fee: 2 per cent of 10,800 euros amounts to 216 euros, of which approximately 108 is payable by Laura each year, plus road tax. And then there is the comparison with the alternative of not opting for the flat-rate tax at all: in that case, the rental income, reduced by a flat rate of 5 per cent, would be added to Laura’s other income and taxed at progressive rates, which for an average or upper-middle income far exceed 21 per cent.

It is also worth noting what one forfeits by opting for the flat-rate tax scheme: for the entire duration of the option, the landlord cannot adjust the rent in line with ISTAT inflation. Over a short-term period of a few months, this is irrelevant; over a 4+4 lease, however, it is a factor to take into account, because over eight years the lack of such an adjustment can erode part of the tax benefit.

IMU: the 25 per cent reduction provided for by law

The second benefit of the agreed rent relates to the IMU.

For properties let at an agreed rent, the law provides for a 25 per cent reduction in tax: this is set out in Article 1, paragraph 760, of Law 160 of 2019. This is not a measure decided by individual local authorities, nor does it depend on their goodwill: it is a national provision that applies automatically, provided that the tenancy agreement is indeed for an agreed rent.

On an annual IMU of 600 euros, that means 150 euros less to pay.

In addition to this statutory reduction, some local authorities introduce their own concessions, setting reduced tax rates for properties let at an agreed rent. Florence, for example, applies a tax rate to these properties that is much lower than the standard rate. These are additional and variable benefits: they should be checked in your local authority’s resolution, year by year.

Taking these three factors together (reduced flat-rate tax, no property tax or stamp duty, and reduced IMU) for a property owner in Laura’s situation, the overall saving compared with a market-rate rent subject to standard taxation comfortably exceeds 1,500 euros a year. This is precisely the figure to compare with the lower rent received, in order to work out whether the scheme is genuinely worthwhile in your area.

Registration and termination of contract

The contract must be registered with the Revenue Agency within thirty days of being signed, using form RLI. This obligation normally falls to the landlord, and the option for the flat-rate tax is exercised on the same form.

Registration can be carried out online via the Agency’s online services, in person at a branch, or by appointing an authorised intermediary (such as an estate agent or a professional). Late registration of the contract results in penalties; failure to register it at all renders the contract null and void, with consequences that primarily affect the owner.

When the contract comes to an end, the key point to bear in mind is that the transitional arrangement is not automatically renewed. Upon expiry, there are three possibilities:

the need for temporary occupation has ceased and the property is returned to the owner: the tenancy comes to an end;

the need persists and can still be substantiated: a new transitional contract is drawn up, with an updated justification, again within the overall limit of eighteen months for that specific need;

If the parties wish to continue on a long-term basis, they enter into a standard contract – either a 4+4 or a 3+2 – subject to the rules governing that type of contract.

What you should not do is allow the relationship to continue in silence, without any action to formalise it. This is the situation in which it is easiest to end up with an unwanted standard tenancy.

Common mistakes to avoid

The grounds for temporary status are either unfounded or unsubstantiated. It is the riskiest mistake of all. If the tenant challenges the tenancy agreement and proves that the stated need did not exist, or never materialised, the agreement may be reclassified as a 4+4 tenancy, with all the rights of continued occupancy that this entails for the tenant. The landlord then finds themselves tied for years to a tenancy that they had specifically structured to avoid this very situation. It is not enough to give a plausible reason: it must be true and, for tenancies lasting more than thirty days, supported by attached documents.

To assume a 10 per cent figure simply on the basis of having a transitional arrangement. The transitional scheme alone accounts for 21 per cent. The remaining 10 per cent comes from combining it with the agreed rent in a municipality with a severe housing shortage. These are two separate options, and both must be taken.

Rent outside the bands set out in the territorial agreement. Even the slightest deviation from the agreed amount will result in the loss of entitlement to the reduced rate, and there is no margin of tolerance. It is advisable to calculate the rent based on the updated agreement and allow for a margin, rather than relying on the maximum value.

Unsupervised contract without a certificate of compliance. If you do not go through the trade associations, the certificate is required. The contract remains valid as a tenancy agreement, but you are not entitled to the tax relief, and the problem tends to come to light only during a tax audit, by which time the reduced tax rate has already been applied for several years.

Using the temporary accommodation as a disguised short-term let. The transitional provision was introduced for residential tenancies. Using it for holiday accommodation exposes you to both contractual and tax-related disputes, and does not entitle you to any tax relief.

Would you like to rent a property without losing the benefits you’re entitled to?

Between the choice of contract type, the terms of the territorial agreement, the declaration of compliance and registration requirements, the difference between a well-drafted contract and a slapdash one amounts to thousands of euros over the course of just a few years. And almost always, the error goes unnoticed at the time of signing.

Idee & Immobili supports property owners in Florence, Prato and Sesto Fiorentino every step of the way: assessing the market rent, checking the applicable territorial agreement bands, choosing the contract type best suited to their objectives, and handling the certification and registration of the contract.

If you’re considering letting out your property, please contact us for a personalised consultation. If the need for a temporary arrangement still exists, the parties may enter into a new contract with an updated and documented justification, whilst still complying with the eighteen-month limit set for that type of contract. If, on the other hand, the intention is to continue on a permanent basis, the option is an ordinary contract, either 4+4 or 3+2.

Which is better value: the transitional scheme or the 3+2 scheme with an agreed rent?

It depends on the timeframe and the objective. If the need is genuinely temporary, a short-term tenancy avoids long-term commitments and allows you to regain possession of the property on a specific date. If, on the other hand, you are planning a long-term tenancy, the 3+2 option offers the same tax benefits with greater continuity: fewer administrative procedures, fewer periods of vacancy between tenants, and generally a simpler selection process, as many reliable tenants are looking for stability. It is also worth noting that the short-term tenancy requires a documented justification, whereas the 3+2 option does not.

Does the agreed rent also apply outside Florence, in Prato or Sesto Fiorentino?

Yes, and with full entitlement to the reduced rate. The agreed rent can always be chosen voluntarily in any municipality, but entitlement to the 10 per cent flat-rate tax applies only in municipalities with a severe housing shortage: Prato falls into this category as the provincial capital, and Sesto Fiorentino as a municipality bordering Florence. In both cases, you must comply with the bands set out in the territorial agreement in force in that municipality – which differ from those in Florence – and, for non-subsidised contracts, obtain a certificate of compliance.

What happens if the stated need for a temporary arrangement does not arise?

The contract risks being reclassified as an ordinary tenancy, with a minimum term of four years plus four, and the associated rights for the tenant. This outcome arises in the event of a dispute; it is therefore not automatic, but the risk is very real when the grounds given were vague or were never substantiated by facts. If circumstances change during the term of the contract, the correct course of action is to notify the other party and renegotiate.

The transitional contract with an agreed rent offers a flat-rate tax of 10 per cent in areas with a severe housing shortage.
